2007 Agricultural Region Re-count
On 3 July 2007, the Electoral Commissioner was informed by His Excellency the Governor that the Hon. Margaret-Anne Rowe MLC, Member for the Agricultural Region, had resigned and her position had subsequently become vacant. Nominations for the vacancy closed at 12 noon on Monday 16 July 2007 for which seven formal nominations from qualified persons were received. The candidates (in ballot paper order) were:

A re-count was then conducted on 16 July 2007 and Mr Brian Charles Ellis was declared to be elected as a member of the Legislative Council to fill the vacancy in the Agricultural Region.

2007 East Metropolitan Region Re-count
On 6 November 2007, the Electoral Commissioner was informed by His Excellency the Governor that the Hon. Louise Clare Pratt MLC, Member for the East Metropolitan Region, had resigned and her position had subsequently become vacant. The vacancy was advertised in accordance with section 156C(1)(a) of the Electoral Act 1907 on Thursday 8 November 2007 in The West Australian and The Australian newspapers. Nominations for the vacancy closed at 12 noon on Monday 19 November 2007.
At the close of nominations the Electoral Commissioner had received eight formal nominations from qualified persons and one nomination from a non eligible person. The eligible candidates (in ballot paper order) were:

Accordingly, the only candidates who could be declared elected at the re-count were the eight who nominated in the prescribed manner set out in section 156C and regulation 25 of the Electoral Act 1907. Under the provisions of section 156D of the Act a full re-count of all ballot papers cast in the most recent Legislative Council election, on 26 February 2005, commenced after the close of nominations on Monday 19 November 2007.
The count was conducted pursuant to schedule 1 of the Act. As votes at the 2005 State general election were counted electronically using a software program, a re-count was required to be conducted in the same manner pursuant to section 156D(4) of the Electoral Act 1907, having regard for the exclusion of the Hon. Louise Clare Pratt.
On completion of the count, the Electoral Commissioner declared Batong Vu Pham to be elected as the member of the Legislative Council for the East Metropolitan Region.
